Terms of service

These Terms set forth the provisions that govern the legal relationship between Mangoslab Corporation (hereinafter referred to as the “Company”) and the customer who is a Nemonic user (hereinafter referred to as the “User”) regarding the use of the Nemonic and all accompanying services (hereinafter referred to as the “Service”). Please read these Terms carefully as they are important. These Terms constitute a legal agreement between the “Company” and the “User” regarding the use of the Nemonic Service. You should read these Terms carefully and if you do not agree to the terms and conditions, you should not access or use the Service.

1. Purpose

The purpose of these Terms is to stipulate the rights, obligations, and responsibilities of the “Company” and the “User” in using the “Services” provided by the “Company”.

2. Definition of Terms

① The definitions of the terms used in these Terms are as follows.

1. “User” means a person who concludes a use contract in accordance with these Terms and Conditions and uses the services provided by the Company.

2. “Service” means the text and image creation platform service utilizing artificial intelligence (AI) software provided by the Company to users and all services incidental to it, and all services related to “Nemonic”.

3. “Application” means the website and mobile application “Nemonic” through which the Service is available.

4. “Content” means the text (including prompt text) that the “User” enters into the “Service” and the images, colors, text, etc. that the Service generates from it.

5. “Points” refer to the electronic payment means provided by the “Company”, which the “User” can recharge and use when utilizing the AI-based services provided by the “Company”, as stipulated in these Terms.

② The definitions of terms used in these Terms, except as provided in Section 1 of this Article, shall be governed by relevant laws and regulations, as well as the policies specific to each service, and anything not stipulated herein shall follow general customary practices.

3. Effectiveness and Amendment of Terms

① These Terms become effective when the “Company” posts them on the Application or notifies the “User”, and the “User” agrees.

② If necessary, the Company may change these Terms and Conditions to the extent that it does not violate the relevant laws and regulations, and when the Terms and Conditions are changed, the Company shall specify the date of application and the reason for the revision, and notify it by posting it on the platform or the connected screen together with the current Terms and Conditions from 7 days before the date of application to the day before the date of application. However, if the Company changes important regulations regarding the rights or obligations of members, it shall notify the above method 30 days before the effective date and notify the member in accordance with Article 24, Paragraph 1.

③ The Company shall be deemed to have agreed to the changed Terms when the Member does not expressly express his/her intention to reject the changed Terms, even though the Company has announced or notified the Member that if the Member does not express his/her intention to reject the changed Terms by the effective date of the change, the Member shall be deemed to have agreed to the changed Terms. Members who do not agree to the changed Terms may not be able to use the Service, and members may stop using the Service and terminate the Use Agreement.

4. Interpretation of Terms

① “Company” may establish separate terms of use and policies for individual services (hereinafter referred to as “Individual Service Terms, etc.”), and in the event of a conflict with these Terms, the “Individual Service Terms, etc.” shall take precedence.

② Any matters or interpretations not specified in these Terms shall be governed by service-specific guidance (FAQ) and relevant laws and regulations or common practice.

5. Acceptance of Terms

① You may use the Service by agreeing to these Terms.

② If you are a minor under the age of 14, you may not be able to use some of the Services even if you agree to these Terms. In addition, if you use the Services for a third party, that third party must also agree to these Terms before they can use the Services.

6. Obligations of the “Company”

① The “Company” shall not engage in any acts prohibited by applicable laws and these Terms and Conditions or contrary to public order and morals, and shall do its best to provide the “Service” continuously and stably.

② The “Company” shall handle any opinions or complaints raised by the “User” in connection with the use of the “Service” if the Company deems them to be justified.

7. Obligations of the “User”

① The “User” shall comply with the matters stipulated in this Agreement and related laws and regulations.

② The “User” shall not engage in any of the following acts.

•

Infringe on the intellectual property rights, including copyrights, of the “Company” or other third parties

•

Damage the reputation or interfere with the business of the “Company” or other third parties

•

Change the information posted by the “Company”

•

Copying, disassembling, imitating, or otherwise modifying the Service by reverse engineering, decompiling, disassembling, or any other processing

•

Using the Service in ways outside of normal usage, such as using an automatic access program that burdens the Company’s server and disrupts normal Service operation

•

The act of sublicensing, renting, leasing, or lending all or part of the “Service”

•

Hack the Service or expel the source of the Service, except as permitted by applicable law and to the extent clearly authorized by law

•

Modify the Service, or create derivative works originating from the Service

•

Distribute the Service for any other purpose

•

Use the Service to conduct business activities without the prior consent of the Company

•

Create, download, share, post, or distribute obscene or sexually explicit content without the Company's prior consent

•

Harassing or threatening other users, or causing pain or inconvenience to any user

•

Other illegal or unfair acts, etc.

③ If the Company incurs damages due to the User's violation of the provisions of these Terms, the User who violates these Terms shall be liable to compensate the Company for all damages incurred by the Company.

④ If the Company receives any claims for damages, lawsuits, or other objections from third parties other than the User due to illegal acts committed by the User in using the Service or violations of these Terms, the User shall indemnify the Company at his/her own risk and expense, and if the Company is not indemnified, the User shall compensate the Company for all damages incurred by the Company as a result.

8. Provision of the Service

① The “Company” may conduct regular inspections if necessary to provide the Service.

② The “Company” shall not be liable for any loss or leakage of User's data during the use of the “Service” unless there is intentional or negligent behavior of the Company.

③ The AI Service is available within the scope of the points provided, and the Company may change the point policy and the services provided without prior notice.

9. Modification and Discontinuation of the Service

①The “Company” may modify, change, or discontinue all or part of the “Services” provided in accordance with operational or technical needs if there are other substantial reasons, such as difficulties in providing the “Services” smoothly and deterioration of profitability due to decreased use, the need to transition to next-generation “Services” in accordance with technological advances, or changes in the Company's policies related to the provision of the Services, and shall notify the contents of the Services prior to such changes.

② The “Company” may modify, discontinue, or change all or part of the “Services” provided free of charge at any time in accordance with the Company's policies and operational needs, and the Company shall notify the contents of the Services prior to such changes. However, no separate compensation shall be paid to the “User” unless there is a special provision in the relevant law.

③ The “Company” may suspend the provision of the “Service” for regular inspection, repair, replacement, breakdown, communication interruption, or operational reasons such as information and communication systems. In this case, the date and reason for the suspension shall be announced through the initial screen of the App or other service provision screens such as the connection screen, and the Member shall be notified in accordance with Article 24, Paragraph 1 or 2, at least 14 days prior to the date of suspension.

④ The “Company” shall not be liable for any problems such as damages caused by the change or suspension of the “Service”.

10. Collection of Information

① The “Company” may collect and utilize information such as the User's device information, OS information, and information on the use of the “Service” and printer to improve the quality of the “Service”, including the operation and stabilization of the “Service”.

② The “Company” may collect and analyze the text (including prompt text) that the “User” enters into the “Service” and the content (images, text, etc.) that the “User” creates to improve the quality of the Service and provide new features. The “Company” collects the content created with the consent of the “User”, and the information is strictly managed and protected.

11. Placement of Advertisements

① The “Company” may provide advertisements through the “Service” screen, homepage, e-mail, SMS, notification messages (Push Notification), etc. in connection with the operation of the “Service”. The recipient of the e-mail, SMS, etc. in which the advertisement is posted may indicate the intention to unsubscribe to the “Company”, and the “Company” shall not provide the advertisement against the user's intention to unsubscribe.

② The “Services” provided by the “Company” include various forms of advertisements such as banners and links, which may be linked to areas and pages provided by third parties.

③ If you are linked to a page provided by a third party, the page is not part of the “Service” of the “Company”, so the “Company” does not guarantee the reliability, stability, etc. of the page and is not responsible for any damage to the “User” caused by it.

12. Attribution of Rights

① Copyright and intellectual property rights for the “Service” belong to the “Company”.

② The “Company” grants the “User” the right to use the “Service” only in accordance with the terms and conditions set forth by the “Company”.

③ All trademarks, service marks, logos, and other intellectual property rights related to the “Service” provided by the “Company”, including the design of the “Service”, text, scripts, graphics created by the “Company”, and transmission functions between “Users”, are owned or licensed by the “Company” in accordance with the laws of the Republic of Korea and foreign countries.

④ The “User” does not own the “Service” or have any copyright in the “Service” by virtue of these Terms of Use, but is authorized to use the “Service” by the “Company”, and the “User” may use the “Service” only for information acquisition or personal use in the form provided by the “Company”.

⑤ The “User” may not use, copy, or distribute the User's information obtained through the “Service” for commercial purposes, except as expressly permitted, and may not copy or distribute the text, scripts, graphics, etc. created by the “Company” using the transmission function between the “User” and the “Company”.

13. Term and Termination

① The license to use the “Service” shall be effective from the time the “User” agrees to these Terms or is provided with the “Service”, whichever is earlier, and shall continue to be valid unless otherwise terminated in accordance with these Terms.

② The “Service” shall terminate automatically if the “User” fails to comply with the terms set forth in these Terms or deletes the Application.

③ Termination of the “Service” will not affect the rights, obligations and liabilities of each party that have accrued prior to termination, regardless of the reason for such termination.

14. Restriction of Use, etc.

① The “Company” may restrict the use of the “Service” if the “User” violates the obligations of these Terms or interferes with the normal operation of the “Service”.

② The “Company” may immediately terminate the Contract if the “User” violates the relevant laws. Upon termination of the contract pursuant to this paragraph, all benefits obtained through the use of the “Service” shall be canceled, and the “Company” shall not compensate the User separately.

15. Compensation for Damages

① If the “Company” incurs damages due to the User's violation of the provisions of these Terms and Conditions, the “User” who violates these Terms and Conditions shall be liable to compensate the Company for all damages incurred by the “Company”.

② If the “Company” receives any claims, lawsuits, or other appeals from third parties other than the “User” due to illegal acts committed by the “User” in using the “Service” or violations of these Terms, the “User” shall indemnify the “Company” at the User's own risk and expense, and if the “Company” is not indemnified, the “User” shall compensate the “Company” for all damages incurred by the “Company” as a result.

③ Termination of the Agreement under these Terms shall not exempt the responsible party from the liability of the preceding paragraph.

16. Limitation of liability

① The “Company” shall be exempted from liability for providing the “Service” if the Company is unable to provide the “Service” due to natural disasters or similar force majeure.

② The “Company” shall not be liable for any obstacles to the use of the “Service” caused by reasons attributable to the “User”.

③ The “Company” shall not be liable for any transactions made between “Users” or between “Users” and third parties through the “Service”, nor shall the “Company” be obligated to monitor the content and quality of products or services advertised by third parties on the screen within the “Service” or through linked websites, nor shall the “Company” be liable for any other liability.

④ The “Company” shall not be liable for the use of the “Service” provided free of charge, unless otherwise specified in the relevant laws and regulations.

⑤ The “Company” and its employees and agents shall not be liable for damages arising from the following matters.

•

Personal damages arising from access to and use of the “Services”, regardless of their nature and circumstances

•

Damages resulting from limitations on the use of the “Service” due to the quality, capacity and technical limitations of Internet services

•

Damages arising from any unlawful interference or interruption by third parties

•

Damages caused by all viruses, spyware and other malicious programs that are illegally transmitted, disseminated or caused to be transmitted or disseminated by third parties using the “Service”

•

Damages arising from errors and omissions in, or destruction of, transmitted data.

•

Damages caused by defamation or other tortious acts arising from the use of the “Service” between “Users”

⑥ The “Company” shall not be liable for any performance, malfunction, or expectation of the “Service” by the “User”, and shall not have any warranty obligation with respect to the “Service”.

⑦ The “Company” shall not be liable for any damages caused by the intentional or negligent acts of the “User” in connection with the use of the “Service”.

⑧ The “Company” does not guarantee the accuracy, completeness, and reliability of the results generated by the “Service”, and shall not be liable for any unexpected errors or results.

⑨ The “Company” shall not be responsible for any data or content shared by the “User”, and shall not be liable for any loss, deletion, alteration, error, etc. of data caused by the “User” during the use of the “Service”.

⑩ The “Company” shall not be liable for any disadvantages caused by the User's use or sharing of data or contents belonging to intellectual property rights such as copyrights of third parties.

⑪ In the event of a dispute between “Users” and each other or between “Users” and a third party in connection with the “Service”, the “Company” shall not intervene in the dispute and shall not be responsible for the outcome of the dispute. In the event that the “Company” has incurred damages or other expenses to a third party in this regard, the “Company” may exercise its right of recourse against the “User”.

17. Jurisdiction and Governing Law

① Lawsuits filed between the “Company” and the “User” shall be governed by the laws of the Republic of Korea.

② Any dispute between the “Company” and the “User” shall be submitted to a court of competent jurisdiction under the Civil Procedure Act.

18. Effect of Agreement

These Terms and Conditions entered into between the “Company” and the “User” in relation to the “Service” are a complete agreement and supersede any prior oral or written agreements, contracts, etc. and even if any part of them is invalid under applicable laws and regulations, the remaining provisions shall remain in full force and effect.

이 약관에는 망고슬래브 주식회사 ( 이하 "회사" 라 한다 ) 와 네모닉 사용자인 고객 ( 이하 "사용자" 라 한다 ) 간의 “네모닉” 및 이에 부수하는 제반 서비스의 이용 ( 이하 "서비스" 라 한다 ) 에 관한 법적 관계를 규정하는 조항이 설명되어 있습니다 . 중요한 내용이니 자세히 읽어 보십시오 . 이 약관은 "회사" 와 "사용자" 간 네모닉 서비스 사용에 대해 체결되는 법적 계약입니다 . "사용자" 는 이 약관을 자세히 읽은 후 이용 약관에 동의하지 않을 경우 , 이 "서비스" 에 액세스하거나 이를 이용하지 않아야 합니다.

제 1 조 (목적)

이 약관은 "회사" 가 제공하는 "서비스" 를 이용함에 따른 "회사" 와 "사용자" 의 권리 , 의무 및 책임 사항을 규정함을 목적으로 합니다.

제 2 조 ( 용어의 정리 )

① 이 약관에서 사용하는 용어의 정리는 다음과 같습니다.

1. “사용자”는 이 약관에 따라 이용계약을 체결하고, 회사가 제공하는 서비스를 이용하는 자를 의미합니다.

2. “서비스”는 회사가 사용자에게 제공하는 인공지능(AI)소프트웨어을 활용하는 텍스트 및 이미지 제작 플랫폼 서비스 및 이에 부수하는 제반서비스로, “네모닉”과 관련된 서비스 일체를 의미합니다.

3. “어플리케이션”이란 서비스를 이용할 수 있는 웹사이트 및 모바일 어플리케이션 “네모닉”을 의미합니다.

4. “콘텐츠”란 “사용자”가 “서비스”에 입력하는 텍스트(프롬프트 텍스트 포함) 및 이를 통해 서비스가 생성하는 이미지, 색체,텍스트 등을 의미합니다.

5. “포인트”란 사용자가 회사의 AI로 제공되는 서비스 이용 시 충전·사용이 가능하도록 회사가 본 약관에 정한 바에 따라 제공하는 전자적 지급수단을 의미합니다.

② 이 약관에서 사용하는 용어의 정의는 본 조 제1항에서 정하는 것을 제외하고는 관계법령 및 서비스별 정책에서 정하는 바에 의하며, 이에 정하지 아니한 것은 일반적인 상관례에 따릅니다.

제 3 조 ( 약관의 효력과 개정 )

① 이 약관은 "회사" 가 어플리케이션을 통해 게시하거나 기타의 방법으로 "사용자" 에게 공지하고 , "사용자" 가 이에 대해 동의함으로써 효력이 발생합니다.

② 회사는 필요한 경우 관계 법령을 위반하지 않는 범위에서 이 약관을 변경할 수 있으며, 약관 변경 시에는 적용일자 및 개정사유를 명시하여 현행약관과 함께 플랫폼 또는 연결화면에 게재하는 방법으로 그 적용일자 7일 전부터 적용일자 전일까지 공지합니다. 단, 회원의 권리 또는 의무에 관한 중요 규정 변경 시에는 적용일자 30일 전에 위 방법으로 공지하고 제24조 제1항의 방법으로 회원에게 통지합니다.

③ 회사는 제2항에 따라 변경된 약관을 공지하거나 통지하면서, 회원에게 약관 변경 적용일까지 거부 의사를 표시하지 않으면 약관의 변경에 동의한 것으로 간주한다는 내용을 공지 또는 통지하였음에도 회원이 명시적으로 약관 변경에 대한 거부 의사를 표시하지 않았을 때 회원이 변경 약관에 동의한 것으로 간주합니다. 변경 약관에 동의하지 않는 회원에 대하여 서비스 이용이 불가할 수 있으며, 회원은 서비스 이용을 중단하고 이용 계약을 해지할 수 있습니다.

제 4 조 ( 약관의 해석 )

① "회사"는 개별 서비스에 대해서 별도의 이용약관 및 정책(이하 "개별서비스약관 등")을 둘 수 있으며, 해당 내용이 이 약관과 상충할 경우에는 "개별서비스약관 등"이 우선하여 적용됩니다.

② 이 약관에 정하지 아니한 사항이나 해석에 대해서는 서비스별 안내(FAQ) 및 관계 법령 또는 상관례에 따릅니다.

제 5 조 ( 약관 동의 )

① "사용자"는 이 약관에 대해 동의를 함으로써 "서비스"를 이용할 수 있습니다.

② "사용자"가 14세 미만의 미성년자일 경우에는 이 약관에 동의하더라도 "서비스" 중 일부를 이용할 수 없는 경우가 있을 수 있습니다. 또한 "사용자"가 이 "서비스"를 제3자를 위해 이용할 경우에는 당해 제3자 역시 이 약관에 동의한 후 이 "서비스"를 이용하여야 합니다.

제 6 조 ( "회사" 의 의무 )

① "회사"는 관련 법령과 이 약관이 금지하거나 미풍양속에 반하는 행위를 하지 않으며, 지속적이고 안정적으로 "서비스"를 제공하는데 최선을 다합니다.

② "회사"는 "서비스" 이용과 관련하여 "사용자"가 제기한 의견이나 불만이 정당하다고 인정할 경우에는 이를 처리합니다.

제 7 조 ( "사용자" 의 의무 )

① "사용자"는 이 약관 및 관계 법령에서 규정한 사항을 준수하여야 합니다.

② "사용자"는 다음 행위를 하여서는 안됩니다.

•

"회사" 또는 기타 제3자의 저작권 등 지적재산권을 침해하는 행위

•

"회사" 또는 기타 제3자의 명예를 손상시키거나 업무를 방해하는 행위

•

"회사"가 게시한 정보를 변경하는 행위

•

리버스엔지니어링, 디컴파일, 디스어셈블 및 기타 일체의 가공행위를 통하여 서비스를 복제, 분해 또는 모방, 기타 변형하는 행위

•

자동 접속 프로그램 등을 사용하는 등 정상적인 용법과 다른 방법으로 "서비스"를 이용하여 "회사"의 서버에 부하를 일으켜 "회사"의 정상적인 "서비스"를 방해하는 행위

•

"서비스"의 전부 또는 일부를 재라이선스 판매, 대여, 임대하여주는 행위

•

관련 법에서 허가된 경우와 법에 의해 명확하게 인정할 수 있는 범위 내의 경우를 제외하고, 본 "서비스"를 해킹하거나 소스를 축출하는 행위

•

"서비스"를 수정하거나, 본 "서비스"에서 기인한 파생 제품을 만드는 행위

•

다른 목적으로 본 "서비스"을 배포하는 행위

•

회사의 사전 승낙 없이 서비스를 이용하여 영업 활동을 하는 행위

•

회사의 사전 승낙 없이 음란하거나 선정적인 내용의 콘텐츠를 제작하여 다운로드 또는 공유, 게시, 배포하는 행위

•

다른 사용자를 희롱 또는 위협하거나, 특정 사용자에게 고통 또는 불편을 주는 행위

•

기타 불법적이거나 부당한 행위 등

③ "사용자"가 이 약관의 규정을 위반함으로 인하여 "회사"에 손해가 발생하게 되는 경우, 이 약관을 위반한 "사용자"는 "회사"에 발생하는 모든 손해를 배상할 책임이 있습니다.

④ "사용자"가 본 서비스를 이용함에 있어 행한 불법행위나 이 약관의 위반행위로 인하여 "회사"가 당해 "사용자" 이외의 제3자로부터 손해배상 청구 또는 소송을 비롯한 각종 이의 제기를 받는 경우 당해 "사용자"는 자신의 책임과 비용으로 "회사"를 면책 시켜야 하며, "회사"가 면책되지 못한 경우 당해 "사용자"는 그로 인하여 "회사"에 발생한 모든 손해를 배상하여야 합니다.

제 8 조 ( "서비스" 의 제공 )

① "회사"는 서비스의 제공에 필요한 경우 정기점검을 실시할 수 있습니다.

② "서비스" 이용 중 "사용자"의 자료가 분실/유출 되어도 이에 대한 "회사"의 고의 또는 과실이 없는 한 책임이 없습니다.

③ AI 서비스는 제공되는 포인트 범위 내에서 이용이 가능하며, 포인트 정책 및 제공되는 서비스 등에 대하여 회사는 사전 공지 없이 변경할 수 있습니다.

제 9 조 ( "서비스" 의 변경 및 중단 )

① "회사"는 이용 감소로 인한 원활한 "서비스" 제공의 곤란 및 수익성 악화, 기술 진보에 따른 차세대 "서비스"로의 전환 필요성, "서비스" 제공과 관련한 "회사" 정책의 변경 등 기타 상당한 이유가 있는 경우에 운영상, 기술상의 필요에 따라 제공하고 있는 전부 또는 일부 "서비스"를 수정, 변경 또는 중단할 수 있습니다.

② "회사"는 무료로 제공되는 "서비스"의 일부 또는 전부를 "회사"의 정책, 및 운영의 필요상 언제든지 수정, 중단, 변경 할 수 있으며, 변경전에 해당 내용을 서비스 내에 공지합니다. 다만, 이에 대하여 관련법에 특별한 규정이 없는 한 "사용자"에게 별도의 보상을 하지 않습니다

③ "회사"는 정보통신 시스템 등의 정기점검, 보수, 교체, 고장, 통신두절 또는 운영상의 상당한 이유가 있는 경우에는 "서비스"의 제공을 일시 중단할 수 있습니다. 이 경우 중단일자 14일 이전까지 중단일자 및 사유를 앱 초기화면 또는 그 연결화면 등 기타 서비스 제공 화면을 통해 공지하고 제24조 제1항 또는 제2항의 방법으로 회원에게 통지합니다

④ "회사"는 본 "서비스"의 변경, 중지로 발생하는 손해 등 어떠한 문제에 대해서도 책임 지지 않습니다.

제 10 조 (정보의 수집)

① "회사"는 "서비스"의 운영, 안정화 등 "서비스"의 품질개선을 위하여 "사용자"의 단말기정보, OS 정보, "서비스" 및 프린터 사용정보 등의 정보를 수집, 활용할 수 있습니다.

② “회사”는 “사용자”가 “서비스”에 입력하는 텍스트(프롬프트 텍스트 포함)와 생성하는 콘텐츠(이미지, 텍스트 등) 정보를 수집, 분석하여 서비스의 품질을 개선하고 새로운 기능을 제공하는 데 활용할 수 있습니다. “회사”는 “사용자”의 동의 하에 생성된 콘텐츠를 수집하며, 해당 정보는 엄격하게 관리되고 보호됩니다.

제 11 조 (광고의 게재)

① "회사"는 "서비스"의 운영과 관련하여 "서비스" 화면, 홈페이지, 전자우편, SMS, 알림 메시지(Push Notification)등을 통하여 광고를 제공할 수 있습니다. 광고가 게재된 전자우편, SMS 등을 수신한 자는 "회사"에게 수신거부의 의사를 표시할 수 있으며, "회사"는 "사용자"의 수신거부 의사에 반하여 광고를 제공하지 않습니다.

② "회사"가 제공하는 "서비스"에는 배너, 링크 등 다양한 형태의 광고가 포함되어 있으며, 이는 제3자가 제공하는 영역, 페이지와 연결될 수 있습니다.

③ 제3자가 제공하는 페이지로 연결될 경우 해당 페이지는 "회사"의 "서비스" 영역이 아니므로 "회사"는 해당 페이지의 신뢰성, 안정성 등을 보장하지 않으며 그로 인한 "사용자"의 손해에 대하여 책임을 지지 않습니다.

제 12 조 (권리의 귀속)

② "회사"는 "사용자"에게 "회사" 가 정한 이용조건에 따라 "서비스"를 이용할 수 있는 이용권만을 부여합니다.

⑤ "사용자"는 명시적으로 허락된 내용을 제외하고는 "서비스"를 통해 얻게 되는 "사용자" 정보를 영리 목적으로 사용, 복사, 유통할 수 없음은 물론 "회사"가 만든 텍스트, 스크립트, 그래픽 등을 "사용자" 상호간 전송기능 등을 이용하여 복사하거나 유통할 수 없습니다.

제 13 조 (기간 및 해지)

① "서비스"에 관한 이용권은 "사용자"가 이 약관에 동의하는 시점이나 "서비스"를 제공받는 시점 중 이른 시점부터 효력을 발생하며 이 약관에 따라 달리 해지되지 않는 한 계속 유효합니다.

② "서비스"는 "사용자"가 이 약관에 정한 조건을 준수하지 않거나 어플리케이션을 삭제하는 경우 자동으로 해지됩니다.

③ "서비스"가 해지되더라도 그 해지 사유에 관계없이 해지 전에 발생한 각 당사자의 권리, 의무 및 책임에는 영향을 미치지 않습니다.

제 14 조 (이용 제한 등)

① "회사"는 "사용자"가 본 약관의 의무를 위반하거나 "서비스"의 정상적인 운영을 방해한 경우, "서비스" 이용을 제한할 수 있습니다.

② "회사"는 "사용자"가 관련법을 위반한 경우에는 즉시 계약해지를 할 수 있습니다. 본 항에 따른 계약해지 시 "서비스" 이용을 통해 획득한 혜택 등도 모두 소멸되며, "회사" 는 이에 대해 별도로 보상하지 않습니다.

제 15 조 (손해배상)

① "사용자"가 이 약관의 규정을 위반함으로 인하여 "회사"에 손해가 발생하게 되는 경우, 이 약관을 위반한 "사용자"는 "회사"에 발생하는 모든 손해를 배상할 책임이 있습니다.

② "사용자"가 이 "서비스"를 이용함에 있어 행한 불법행위나 이 약관의 위반행위로 인하여 "회사"가 당해 "사용자" 이외의 제3자로부터 손해배상 청구 또는 소송을 비롯한 각종 이의 제기를 받는 경우 당해 "사용자"는 자신의 책임과 비용으로 "회사"를 면책시켜야 하며, "회사"가 면책되지 못한 경우 당해 "사용자"는 그로 인하여 "회사"에 발생한 모든 손해를 배상하여야 합니다.

③ 본 약관에 따른 계약이 해지되더라도 귀책당사자의 전항의 책임은 면제되지 않습니다.

제 16 조 (책임제한)

① "회사"는 천재지변 또는 이에 준하는 불가항력으로 인하여 "서비스"를 제공할 수 없는 경우에는 "서비스" 제공에 관한 책임이 면제됩니다.

② "회사"는 "사용자"의 귀책사유로 인한 "서비스" 이용의 장애에 대하여는 책임을 지지 않습니다.

③ "회사"는 "사용자" 간 또는 "사용자"와 제3자 상호간에 "서비스"를 매개로 하여 이루어진 거래 등에 대해서는 책임을 지지 아니하며, 제3자가 "서비스" 내 화면 또는 링크된 웹사이트를 통하여 광고한 제품 또는 서비스의 내용과 품질에 대하여 감시할 의무가 없으며 기타 어떠한 책임도 지지 아니합니다.

④ "회사"는 무료로 제공되는 "서비스" 이용과 관련하여 관련 법령에 특별한 규정이 없는 한 책임을 지지 않습니다.

⑤ "회사" 및 "회사"의 임직원 그리고 대리인은 다음과 같은 사항으로부터 발생하는 손해에 대해 책임을 지지 아니합니다.

그 성질과 경위를 불문하고 "서비스"에 대한 접속 및 "서비스"의 이용 과정에서 발생하는 개인적인 손해

•

인터넷 서비스의 품질, 용량 및 기술적 한계에 따라 따른 "서비스"의 이용 제한에 따른 손해

•

제3자의 모든 불법적인 방해 또는 중단행위로부터 발생하는 손해

•

제3자가 "서비스"를 이용하여 불법적으로 전송, 유포하거나 또는 전송, 유포되도록 한 모든 바이러스, 스파이웨어 및 기타 악성 프로그램으로 인한 손해

•

전송된 데이터의 오류 및 생략, 누락, 파괴 등으로 발생되는 손해

•

"사용자"간의 "서비스" 이용 과정에서 발생하는 명예훼손 또는 기타 불법행위로 인한 손해

⑥ "회사"는 "서비스"의 성능, 오동작, "사용자"의 "서비스"에 대한 기대 등에 관하여 책임을 지지 않고, 본 "서비스"에 대하여 어떠한 보증의무도 없습니다.

⑦ "회사"는 "서비스" 이용과 관련하여 "사용자"에게 발생한 손해 가운데 "사용자"의 고의, 과실에 의한 손해에 대하여 책임을 지지 않습니다.

⑧ "회사"는 “서비스”로 생성된 결과물의 정확성, 완전성 및 신뢰성에 대해 보증하지 않으며, 예기치 않은 오류나 결과에 대해 법적 책임을 지지 않습니다.

⑨ "회사"는 "사용자"가 공유한 데이터나 콘텐츠 등에 대해서 아무런 책임을 지지 않습니다. 또한 "서비스" 이용 중에 "사용자"의 귀책으로 인해 생긴 데이터의 손실, 삭제, 변형, 오류 등에 대해서도 책임을 지지 않습니다.

⑪ "서비스"와 관련하여 "사용자" 상호간 및 "사용자"와 제3자 간에 발생한 분쟁이 발생한 경우 "회사"는 그 분쟁에 개입하지 않으며 그 분쟁의 결과에 책임이 없습니다. 이와 관련하여 "회사"가 제3자에게 손해를 배상하거나 기타 비용을 지출한 경우 "회사"는 "사용자"에게 구상권을 행사할 수 있습니다.

제 17 조 (재판관할 및 준거법)

① "회사"와 "사용자"간 제기된 소송은 대한민국 법을 준거법으로 합니다.

② "회사"와 "사용자"간 발생한 분쟁에 관한 소송은 민사소송법 상의 관할법원에 제소합니다.

제 18 조 (계약의 효력)

이 "서비스" 와 관련하여 "회사" 와 "사용자" 간 체결되는 본 약관은 완전한 계약으로 기존에 맺어진 어떠한 구두나 서면에 의한 합의 , 계약 등 보다 우선하여 적용되며 , 관계법령 등에 따라 그 중 일부가 무효가 되더라도 나머지 조항은 그대로 유효하게 적용됩니다.
